CJ throws out Martin Amidu’s petition for Kissi Agyebeng removal

A plea to remove Kissi Agyebeng, the Special Prosecutor, from his position has been denied by Chief Justice Gertrude Sackey Torkornoo.

Martin Amidu wrote to President Akufo-Addo on April 30, 2024, requesting that Agyebeng be dismissed. On May 6, 2024, Justice Torkornoo received the petition for reconsideration.

But the petition was dismissed because the Chief Justice determined it lacked merit.

In his petition, former Special Prosecutor Martin Amidu claimed severe wrongdoing, including procurement violations in the purchase of cars for the OSP and egregious abuses of power involving judges and the administration of justice, which he claimed called for Kissi Agyebeng’s removal from office.

However, the Chief Justice determined that Martin Amidu’s petition did not satisfy the necessary standard to create a prima facie case for Kissi Agyebeng’s dismissal as Special Prosecutor since it did not contain enough proof or legal justification to back up the accusations.

The Chief Justice came to the conclusion that the petition lacked the requisite legal and factual support to necessitate a second look or other action.

Martin Amidu said, affirming the Chief Justice’s ruling, “I have today received a one-page letter from the Presidency with reference number OSP 307/24/659 dated 2 July 2024 notifying me that: “…. Regarding your petition, the Honorable Chief Justice, Mrs. Justice Gertrude Sackey Torkornoo, has presented her assessment of whether or not there is a prima facie case.

“I was then informed that: “In accordance with section 15 (3) of the Office of the Special Prosecutor Act, 2017, the Chief Justice determined that the factual and legal foundation of the petition fall short of the standard required to establish a prima facie case for the removal of the Special Prosecutor,” a piece allegedly written by Mr Amidu said.
