Mathew Nyindam goes to Supreme Court over Kpandai constituency election ruling

Mathew Nyindam, the Member of Parliament (MP) for Kpandai Constituency, has submitted a request to the Supreme Court to overturn the High Court, Commercial Division’s ruling in Tamale that invalidated his parliamentary election win.

Nyindam, via his attorney, Gary Nimako Marfo, contends that the High Court mistakenly assumed jurisdiction regarding the petition submitted by NDC candidate Daniel Nsala Wakpal, who disputed the December 7, 2024, parliamentary election results in Kpandai.

The petition, submitted on January 25, 2025, was filed 32 days after the results were announced in the Government Gazette on December 24, 2024, surpassing the 21-day legal timeframe set out in Section 18 of the Representation of the People Law, 1992 (P.N.D.C.L. 284). Nyindam argues that the postponement made Wakpal’s petition invalid and that the High Court lacked the legal power to consider it.

“The Parliamentary Election Petition filed by the 1st Interested Party on 25th January 2025, in respect of the Parliamentary Election held at the Kpandai Constituency on 7th December 2024, was invalid and could not have properly invoked the jurisdiction of the High Court, Commercial Division, Tamale,” Nyindam’s affidavit submitted to the Supreme Court states.

The ruling from the High Court, issued on November 24, 2025, nullified the entire Kpandai election and mandated a new election within 30 days. Nyindam is currently pursuing a judicial review in the form of certiorari to annul the ruling, along with all processes and proceedings stemming from the supposedly invalid petition.

The Supreme Court is set to review the case on Tuesday, December 16, 2025. Nyindam’s legal representatives contend that the case presents a critical jurisdictional question, claiming that the High Court’s ruling, if permitted to remain, would jeopardize the justice system and the legal boundaries surrounding election petitions.

In the Kpandai parliamentary election, Nyindam of the New Patriotic Party (NPP) was announced winner with 27,947 votes (53.47%), defeating Wakpal from the National Democratic Congress (NDC), who received 24,213 votes (46.33%).
