A writ issued by Alexander Amponsah Esq. of Adom Legal Consult is asking the Sunyani High Court to award Nine Hundred Thousand Ghana Cedis (GH₵900,000) as compensation for general damages to his client, hon. Vincent Antwi Agyei, the Municipal Chief Executive for Sunyani Municipal in the Bono Region.
The writ, issued on behalf of the plaintiff on 18th December, 2025, exonerate the MCE from allegations posted on a Facebook page/wall by the defendant, Raphael Cubagee, a suspended assembly member for Abonsuam electoral area in Sunyani municipal of the Bono Region.
The particulars of the defamatory publications, as contained in the writ, state that the defendant wrote: “Eii, painting of just 1 bungalow can cost GH₵550,000 stealing at its highest point so what will be the cost of the building itself Vincent Antwi Agyei and Lawyer Amponsah should go to the Special Prosecutor themselves Eii Ghana no,no,no.”
Additionally, on 10th October, the defendant is quoted as posting: “Board member of the Sunyani Teaching Hospital Alexander Amponsah and Vincent Antwi Agyei, MCE order staff of the assembly to disrespect a court order and run back to the same court for justice Eiii hmmm.”
The plaintiff also said Raphael Cubagee wrote: “Demonstration on 24 October for removal of MCE Vincent Antwi Agyei and Lawyer Alexander Amponsah from office for the cover-up and also stealing from the people.”
Lastly, the defendant emphatically stated, “Pls JDM sack the MCE and Lawyer Alexander Amponsah as board member of the teaching hospital for cover-up of stealing GH₵39 million belonging to the assembly because of kickbacks.”
The solicitor argues that these public publications are false and have essentially labelled the plaintiff a thief and a criminal, which is offensive, despicable, and defamatory, aiming to incite the public against him.
According to Plaintiff’s lawyer, his client has no knowledge of any bungalow painting and has never dealt with Alexander Amponsah on such a project, contrary to Raphael Cubagee’s claims
The writ states that accusing the plaintiff of disobeying a court order portrays him as lawless and unfit to lead the good people of Sunyani.
The plaintiff contends that the Facebook comments are untrue, depicting him as a crafty individual engaging in shady deals for personal gain, detrimental to the public.
He denies the GH₵39 million theft allegation, stating the publication aims to defame him, portraying him as greedy, heartless, untrustworthy, and a shameless politician lacking dignity.
The plaintiff argues that false publications present him as a person of no integrity, undeserving of his position as Municipal Chief Executive, due to alleged corrupt conduct.
In his statement of claims, the Plaintiff seeks an Order from the Sunyani High Court compelling the defendant to retract and/or remove the libelous defamatory publications from the same medium they were posted and issue an unqualified apology.
A perpetual injunction restraining the defendant, their agents, and associates from publishing further defamatory statements against the Plaintiff.
He demands general damages of nine hundred thousand Ghana Cedis (GH₵900,000.00) for libel, stemming from the defamatory publications made by the defendant on his Facebook page.
On Thursday, 17th July 2025, the Assembly Member for Abonsuam electoral area, Hon. Raphael Cubagee was suspended following findings of 10 charges of misconduct and breaches of the assembly’s Model Standing Orders.
The findings include unauthorized video recording of sub-committee meetings, improper signing of sub-committee reports, unlawful submission of Sub-committee reports and recommendations, breach of procedural withdrawal from sub-committee duties.
The rest are public misconduct and unsubstantiated allegations against assembly officials, unauthorized engagement of public officials, airing of inappropriate private communication, misrepresentation to the executive committee, insubordination towards the municipal executive and use of abusive and disrespectful language.
Until his suspension, Raphael Cubagee was a member of the Sunyani Municipal Assembly’s works sub-committee.
