Supreme Court summons NDC Kpessa-Whyte over ‘a stupid court’ comment

Dr. Michael Kpessa-Whyte, a lecturer at the University of Ghana and unsuccessful National Democratic Congress (NDC) candidate for Shai Osudoku, has been summoned by the Supreme Court to provide justification for why he should not be held in contempt for allegedly disparaging the country’s highest judicial body and calling it “a stupid court.”

In a recent tweet, Dr. Kpessa-Whyte asserted that the Supreme Court is evolving into a “Stupid Court.”

The university instructor also bemoaned the state of Ghana’s current court in his tweet, accusing it of being politicized and lacking common sense.

His tweets were posted within 24 hours after Ghana’s Supreme Court ruled that the name of NDC MP James Gyakye Quayson should be removed from the records of Parliament due to irregularities that occurred during his nomination and election in 2020.

The academic turned politician tweeted again three days after his initial message, letting people know that they had been in touch with him regarding the message’s apparent reference to the Ghanaian court.

He made it clear that his tweets did not allude to Ghana’s judicial system.

“Thanks to all who have asked questions about my May 19th, 2023 tweet. For the avoidance of doubt, I follow judicial decisions in many countries and, so, the said tweet cannot be pinned to Ghana. It has more to do with developments elsewhere including the US. We live in a global village.”

The Supreme Court mandated that Mr. Gyakye Quayson’s name be removed off the list of MPs in a unanimous ruling.

On May 17, 2023, the court ruled that Mr. Gyakye Quayson’s election as the MP for Assin North was unlawful.

After the Cape Coast High Court invalidated Mr. Quayson’s election as the MP for Assin North in July 2021, a resident of Assin Bereku in the Central Region, Mr. Michael Ankomah Nimfa, brought him before the court to prevent him from continuing to hold himself out as an MP.

The petitioner had argued before the Supreme Court that James Gyakye Quayson had violated the Constitution by continuing to hold office notwithstanding a High Court ruling that had invalidated his election and was unfair to the residents of Assin North.
