The Ghana Bar Association (GBA) has criticized a recent comment made by the Dormaahene regarding the trial of James Gyakye Quayson, the MP for Assin North, as being improper.
President Nana Akufo-Addo and the Attorney General have been pleaded with by Osagyefo Oseadeeyo Agyemang Badu II to urgently halt the trial.
In connection with a number of alleged offenses in the run-up to the 2020 parliamentary election, Quayson is accused of forgery and perjury. He has entered a not guilty plea to five counts of forging a passport or travel document, making a false statutory declaration intentionally, lying under oath, and making a false declaration for office.
“As a matter of urgency, I [Dormaahene] am appealing to the President of the Republic [Akufo-Addo], if he has any role to play, that trial should be aborted, and the Attorney-General should as a matter of urgency file a nolle prosequi to end that particular decision and abort the criminal case against Mr Quayson,” the Dormaahene said.
Saviour Kudze, the GBA’s public relations officer, indicated that the Dormaahene, who also serves as a high court judge, to turn his criticism into a review when appearing on the Asaase Breakfast Show on Tuesday (4 July).
Kudze expressed his worry, saying, “For me.” “I don’t think it should be done at that forum,” he added, “even if you were advising the Attorney General as your subject.”
“You have all the power you need as a high court judge to have access to the Attorney General to say that, ‘Looking at the happenings in the country, I think we should do this, or I advise that exercise this power if you think it will help the situation.'” he continued.
“I think his concern has to do with the fact that James Gyakye Quayson won the by-election by 57%, so for that alone a case should be discontinued against him. I don’t think that is the best.”
Godfred Yeboah Dame, Attorney-General (A-G) and Minister for Justice, has criticized recent commentary on prominent criminal cases as “transgressing permissible limits of free speech” and “unduly interfering with the work of State Prosecutors.”
The A-G stated that the public is advised against unreasonable statements that could jeopardize the cases of Republic vs. James Gyakye-Quayson, Republic vs. Dr. Stephen Opuni & 2 Others, and Republic vs. Cassiel Ato Forson and two others.
After James Gyakye Quayson won the by-election, prominent figures, including the Dormaahene and President of the Bono Regional House of Chiefs, Osagyefo Oseadeeyo Agyemang Badu II, have pleaded with President Akufo-Addo to become involved in the prosecution of the MP for Assin North.
Following his dismissal as the Member of Parliament for Assin North, Mr. Quayson is currently the target of criminal allegations.
He is charged with neglecting to renounce his dual citizenship before submitting his petition to run in the 2020 parliamentary election.
