Adu Boahene, wife sue AG, EOCO over Gh¢200m bail conditions

The High Court will shortly make a decision regarding the bail request submitted by attorneys for former National Signals Bureau (NSB) Director-General Kwabena Adu Boahene and his wife, Angela Adjei Boateng.

The Economic and Organised Crime Office (EOCO) and the Attorney General are the respondents in this action.

Both of them is still being held while contesting what their defense team claims are “unjustifiably harsh” bail requirements set by the prosecution.

According to their attorneys, the bond demands—GH¢80 million for his wife and GH¢120 million for Adu-Boahene—are exorbitant and seem to be an attempt to get around the constitutional restrictions on imprisonment without trial. They contend that these terms essentially prolong their clients’ custody above the 48-hour limit permitted by law.

“The Respondents with a clear motive to incarcerate the Applicants beyond the 48-hour period as spelt out by the Constitution have imposed burdensome and unreasonable conditions on the Applicants as the precondition for their granting them bail,” it read.

In their application, the lawyers further argued that the authorities are infringing on their clients’ rights.

“The justification for the bail is solely at the discretion of the Respondents,” they declared that the action was a blatant infringement on their clients’ right to liberty. The defense team also charged the state with preventing due process of law and failing to provide its clients with adequate legal representation.
