Alexander Afenyo-Markin, the leader of the majority, declared that he had petitioned the Supreme Court for an injunction against the minority’s attempts to declare the seats of independent candidates vacant.
This comes after former Minority Leader Haruna Iddrisu declared that his party would use Article 97(1)(g) of the Constitution, which stipulates that an MP must resign from their seat if they leave the party they were elected to or attempt to run for office again as an independent.
According to Haruna Iddrisu, he has already sent a letter to the Speaker declaring four parliamentary seats open, three of which are occupied by NPP MPs and one by an NDC MP.
The NDC, which now has 137 MPs, would become the dominant party if this effort is successful, drastically altering the balance of power in Parliament.
In 2020, when the seat of then-NPP MP Andrew Amoako Asiamah was declared vacant, Majority Leader Afenyo-Markin stated his wish to avoid a repeat of that event. He believes that this matter will be resolved by the Supreme Court.
Justice Abdulai, a constitutional lawyer, pointed out that the four MPs, who stand to lose their seats if they declare their intention to run as independents, have little legal leeway.
