The Court of Appeal’s ruling, which exonerated and released Minority Leader Dr. Cassiel Ato Forson and Richard Jakpa in the ambulance case, has been appealed by the Office of the Attorney General.
The office highlighted the majority decision’s misapplication of the level of proof needed to determine whether a case has been presented for the accused to respond as grounds for appeal in the Notice of Appeal filed on August 8, 2024.
The notice of appeal further claims that the majority decision’s conclusions—that the letters of credit did not qualify as a payment under the terms of the contract—are unsustainable and at odds with the facts presented in the case.
The appeal also claims that there was a significant miscarriage of justice and that the majority decision’s conclusion that the Ministry of Health was responsible for the financial loss was riddled with basic mistakes.
The prosecution’s argument that the majority ruling misunderstood and incorrectly applied the fundamental elements of the offenses the accused were charged with is one of the other grounds for appeal.
In order to allow the accused to continue with their defense, the prosecution is requesting that the Supreme Court reverse the decision to acquit and dismiss them.
