There should be a legislative limit on the number of Justices nominated to Ghana’s Supreme Court, according to Speaker of the Parliament Alban Bagbin.

At the moment, the constitution stipulates that there must be nine judges, but it does not state how many can serve.

President Nana Addo Dankwa Akufo-Addo nominated Justice Sophia Rosetta Bernasko Essah and Professor Richard Frimpong Oppong as the new Justices, replacing retiring Justice Nii Ashie Kotey and the soon-to-retire Justice Mariama Owusu. This move toward change follows their nomination.

Speaker Bagbin emphasized in his speech to the legislature the necessity of a cap on the number of justices on the Supreme Court in order to stop uncontrolled growth in appointments.

“And so, we’re being called through this letter as a House to look into the issue of a full complement of the Supreme Court, should it be 13, 15, 20, 40, or 100. It’s for this House to decide,” Speaker Bagbin remarked.

“I’m urging you to look at this issue, given the provision reforms or to pass legislation and give an upper limit as to how many can be at the Supreme Court of a country of 33 million people,” he said in his statement.

Speaker Bagbin set the groundwork for legislative deliberations on the nominations and the more general subject of judicial appointments by referring the topic to the Appointments Committee for assessment and comment following the President’s nominations.
