CJ’s removal: Supreme Court dismisses Justice Torkonoo’s injunction application

A supplemental affidavit submitted by Chief Justice Gertrude Torkonoo, who was suspended, was dismissed by the Supreme Court. She filed the document as part of her legal battle to halt the removal process on Wednesday, May 28, 2025.

Justice Torkonoo called the procedure a “mockery of justice” and asserted in the affidavit that she was receiving unfair treatment. Additionally, she said that the treatment she experienced was cruel and degraded her self-esteem.

However, the Supreme Court ruled that the affidavit made reference to confidential issues that were addressed by a committee looking into her potential dismissal. The law mandates that these meetings take place behind closed doors.

Deputy Attorney General Justice Srem Sai’s objection was accepted by a five-judge panel. He claimed that the affidavit violated Article 146(8) of the Constitution, which stipulates that any inquiry into a judge’s dismissal must be kept confidential.

Former Attorney General Godfred Yeboah Dame, who represented Justice Torkonoo, said that the affidavit was sent solely to the court and not made public. That means it didn’t violate any rules, he said.

The Supreme Court disagreed, holding that the affidavit did violate the Constitution’s need of confidentiality. Consequently, the affidavit was formally struck out by the court.
