Court dismisses Ken Ofori-Atta’s request to stop the OSP from declaring him wanted

Former Finance Minister Ken Ofori-Atta filed a motion to stop the Office of the Special Prosecutor (OSP) from listing him as wanted before his scheduled appearance on June 2, 2025, but the Human Rights Court denied it.

Regarding his time in office, Mr. Ofori-Atta is the subject of numerous investigations by the OSP and other state agencies. He had requested that the court prevent the OSP from publishing his picture online and from issuing a “wanted” notice.

He is currently under an active Interpol Red Notice, and in order to secure his return to Ghana, extradition procedures have started with the appropriate authorities.

In order to stop the OSP’s operations or contest the issuing of arrest warrants in the ongoing investigations, he has launched a number of legal proceedings against the Republic and the OSP, including the rejected application.

Due to Mr. Ofori-Atta’s noncompliance with invitations to be questioned over ongoing corruption investigations, the OSP declared him a fugitive from justice on February 12.

The anti-graft agency defended the action by claiming that his absence was interfering with its operations and that a public announcement was required to help apprehend him.

But the lawyers representing Mr. Ofori-Atta argued that the declaration was arbitrary and unfair.

Moreover, they said that their client, a well-known investment banker and former minister, had not intentionally avoided the OSP but rather was coping with significant health issues, such as getting ready for a significant medical surgery.

His legal team maintains that before the declaration, the OSP was explicitly informed of these health concerns.

His lawyers are not happy, even though the OSP declared on February 18, 2025, that it had taken Mr. Ofori-Atta’s name off the wanted list after receiving assurances that he will return to Ghana.

Mr. Ofori-Atta requested that the court rule that the actions of the Special Prosecutor violated his rights to administrative justice, fair treatment, and dignity.

In addition, he sought compensation for the harm the OSP’s announcement caused.

However, the court decided against Ken Ofori-Atta today.
