Duffour’s suit incompetent ought to be dismissed – NDC

Attorneys for the National Democratic Congress (NDC) in opposition have asked an Accra High Court to reject a complaint that they claim is frivolous and filed by flagbearer candidate Dr. Kwabena Duffuor.

They add that the case lacks a legal foundation.

“We submit that the plaintiff’s suit is incompetent and therefore ought to be dismissed in limine. Again, the plaintiff has not been able to demonstrate on the face of his pleadings and affidavit that it is just or convenient for the Honourable Court to grant the injunction that he seeks”.

“That in reference to the allegations of errors and inaccuracies emanating from the photo albums, I state that such errors have been largely and comprehensively dealt with by the NDC. That for instance, on the plaintiff’s allegations of the number of cases of people having the same Voter I.D card numbers which resulted in people having the same pictures and names on the photo album have been resolved” the party’s attorneys argue in court documents.

The campaign team for Dr. Duffuor claims it was not given a complete list of those eligible to vote in the May 13 presidential and parliamentary elections.

He consequently requests that the court order the elections to be postponed and that the party work with candidates to develop a plan for creating an accurate voter list.

The Electoral Commission has previously stated that until the legal difficulties are settled, it will not be overseeing the elections.

The NDC, on the other hand, argues that it has so far fixed the majority of the mistakes found by Dr. Duffuor’s team.

The party responds to allegations that the list has been inflated by the insertion of an extraordinary list by claiming that this list was created to address purported errors.
