Former Finance Minister sues National Security operatives for ‘trespassing’ on his home

Ken Ofori-Atta, the former finance minister, is suing National Security agents for illegally intruding on his property and is requesting damages.

About 12 people, including five in military uniforms, one in a police outfit, and others in ordinary clothing, broke into Mr. Ofori-Atta’s Cantonments home on February 11, 2025.

Two senior police officers, DSP Bismark Boakye Ansah and Chief Inspector Mensah, are being sued by the High Court in the writ for allegedly invading his private property and infringing his right to privacy.

The statement of claim states that at the time of the incident, Mr. Ofori-Atta was abroad receiving medical care.

A group of 12 people, including the two defendants, nine military soldiers with assault guns, and multiple plainclothes officers, invaded the premises without permission or prior warning, according to his domestic staff.

Without a warrant or an explanation of the search’s objectives, the crew searched the whole property, including private areas like closets, the kitchen, and bedrooms.

The complainant claims that in addition to being trespassing, the raid violated his right to privacy. He further claims that one of the raiding team members recorded the entire operation on a cell phone, which further exacerbates the privacy violation.

The suit indicated that the raiding team “did not produce any form of warrant nor indicate to the Plaintiff’s domestic staff the basis for the search but warned the domestic staff to desist from using their mobile phones throughout the entire period of the unauthorized operation.”

According to reports, the incident left Mr. Ofori-Atta’s domestic staff terrified and experiencing extreme shock and worry.

Additionally, Mr. Ofori-Atta asserts that the raid has harmed his reputation both nationally and internationally.

“Plaintiff says further that the raid on the property which gained notoriety both domestically and internationally has not only exposed him to public ridicule, resentment and scorn but also portrayed him as a criminal and this has negatively impacted his hard earned reputation in the international community,” parts of the document read.

He maintained that the incident has made him appear to be a criminal, which has caused him to be mocked and derided by the public.

The National Intelligence Bureau, the Chief of the Defence Staff, and the Inspector General of Police have all been contacted for clarification on the legitimacy and intent of the raid, but no answer has been received.

Ken Ofori-Atta is suing for a number of remedies, such as a permanent injunction to stop future interference with his property and privacy rights, damages for trespassing and privacy violations, and a declaration that the defendants’ activities were illegal. In addition, he is requesting fees and aggravated damages.

The defendants, Chief Inspector Mensah and DSP Bismark Boakye Ansah, have been ordered to appear within eight days of receiving the writ.
