Martin Kpebu lauds OSP for declaring Ken Ofori-Atta wanted again

Martin Kpebu, a private attorney, supported the Office of the Special Prosecutor’s (OSP) decision to declare former Finance Minister Ken Ofori-Atta wanted, although he feels that a more pragmatic approach could have been taken into account.

“It is good that Ken Ofori-Atta has been declared wanted again,” Kpebu said on Saturday, June 7, 2025, on TV3’s The Key Points.

“But I expected the Special Prosecutor to have explored using video conferencing facility to interrogate Ken Ofori-Atta.”

His remarks were made a few days after the OSP formally classed the former minister as a fugitive from justice due to his repeated refusals to appear in person for questioning.

Announced on June 2, 2025, the agency’s action marks a significant uptick in its efforts to hold prominent individuals in former President Akufo-Addo’s administration accountable.

The OSP has now gone global in response to Ofori-Atta’s ongoing absence, requesting that INTERPOL issue a red notice for his arrest and potential extradition.

The action implies that the office of the Special Prosecutor has run out of domestic alternatives and is now depending on international law enforcement to enforce compliance.

Kpebu stressed that the use of contemporary communication technologies may have provided a compromise, while acknowledging the legitimacy of the OSP’s actions.

According to him, if conducted in a legally compliant way, an online questioning might have accomplished the same investigative goals without leading to such a stalemate.

Ofori-Atta’s designation as a wanted individual has sparked legal and public debate, posing issues with due process, accountability, and the willingness and capacity of Ghana’s institutions to hold influential officials accountable.
