Amenorpe Philbert Fummey, the National Democratic Congress (NDC) Parliamentary Candidate for Nsawam Adoagyiri in the Eastern Region, has sued the Electoral Commission (EC) in an attempt to hold a new election in the constituency after disputes delayed the compilation of parliamentary results in some constituencies throughout the nation.
The plaintiff in a lawsuit against Frank Annoh Dompreh, the parliamentary candidate for the New Patriotic Party (NPP), claimed that the EC had collated the results for the constituency using erroneous assertions of results, or pink sheets.
The petition was filed today, Friday, December 13, at the Accra High Court by Godwin Edudzi Kudzo Tameklo, the attorney for Mr. Fummey and the NDC’s Director of Legal.
The plaintiff has filed an application for interlocutory injunction in addition to the lawsuit, requesting that the results for the constituency not be compiled until the main suit’s outcome is known.
The collation center was attacked and some of the pink sheets were damaged by individuals Mr. Fummey claimed were NPP members.
The plaintiff claimed that he and his team had gathered 118 of the 203 pink sheets at the time of the alleged attack, and that as a result of the attack, he only had 137 of them. He also claimed that the EC had told him that it had 80% of the pink sheets under its control.
Although some of the pink sheets were destroyed, the lawsuit claimed that the EC chose to proceed with the collation.
“The Plaintiff avers that in a shocking twist of events, he has been summoned by the Electoral Commission to continue and finish up with the collation of the results for the constituency, with the Electoral Commission, contrary to its earlier position, now indicating and insisting that it has all the pink sheets available,” the plaintiff submitted.
Given the above claims, the plaintiff is urging the court to declare that the integrity of the election in Nsawam Adoagyiri had been undermined due to the “absence, incomplete, and/or questionable nature of the pink sheets”.
