Supreme Court adjourns Chief Justice removal case to May 6

The Supreme Court has once again postponed the hearing of a well-known injunction case that aims to prevent the Council of State and President John Dramani Mahama from considering petitions to remove the Chief Justice.

The court rescheduled its hearings on Wednesday due to the absence of His Lordship Justice Samuel Asiedu, one of the panel’s five members. Her Ladyship Justice Henrietta Mensah Bonsu, the presiding judge, listed inescapable circumstances, saying:

“We have had problems and for unavoidable reasons have to adjourn.”

Officially, the case has now been rescheduled for May 6, 2025.

Godfred Yeboah Dame, the plaintiff’s attorney, filed a legal challenge in which he contends that the President should freeze all acts pertaining to the petition until the Supreme Court makes a decision regarding the constitutionality of the procedure of determining a prima facie case.

Attorney General Dr. Dominic Ayine has strongly denied that the President is bound by the filed injunction in response to these allegations.

Following court proceedings, Dr. Ayine told reporters “The President cannot be enjoined from undertaking his constitutional duty. He is merely performing a procedural obligation as laid out under the Constitution. The injunction application does not override that.”

Constitutional interpretation and the propriety of evaluating whether the petition to remove the Chief Justice has a prima facie case are at the heart of the disagreement.

The issue has attracted a lot of public attention, and political analysts and legal experts are keeping a close eye on the legal dispute because of its implications for presidential powers, judicial independence, and constitutional checks and balances.

Both sides are anticipated to keep arguing whether the President’s participation in the preliminary review of the petition breaches the separation of powers or simply reflects his constitutional duty as the country approaches the May 6 sitting.
