According to the Office of the Special Prosecutor (OSP), even without a court warrant, it is permitted to make arrests of people who are allegedly involved in corrupt activities within public institutions.
The OSP indicated in a tweet sent out on June 15, 2023 that it gets these authority from its function as a law enforcement organization.
“The general public is advised, that in exercise of its police powers, the Office of the Special Prosecutor can arrest without a warrant, any person it reasonably suspects of having committed corruption or corruption-related offences,” parts of the tweet read.
Following a court order prohibiting the arrest of Charles Bissue, the former secretary of the Inter-Ministerial Committee on Illegal Mining (IMCIM), the OSP released a statement.
Charles Bissue’s attorney, Nana Agyei Baffour Awuah, claims that the injunction was given by the Human Rights Court 2 in Accra, which is presided over by Justice Nicholas MC Abodakpi. The injunction prevents the OSP from issuing a wanted notice for Charles Bissue.
The injunction was issued following trials on Thursday, June 15, 2023, according to attorney Baffuor, who revealed this to Ghanatodayonline.com. It would endure for 10 days.
“Justice Nicholas MC Abodakpi of the Human Rights Court 2, has, following an application by the lawyers of Charles Bissue made an order for Interim Injunction, restraining the Office of the Special Prosecutor its agents, assigns and/or persons howsoever described and claiming through it from:
“Executing the arrest warrant it purports to have procured; applying for further Arrest Warrant pending the determination of the substantive matter and Publishing notices purporting the Applicant to be wanted pending the determination of the substantive matter,” The attorney sent a press release.
The trial was also postponed, he proceeded, to Thursday, June 22, 2023 by the court.
Charles Bissue, a former secretary to the Inter-Ministerial Committee on Illegal Mining (IMCIM), was designated sought by the Office of the Special Prosecutor.
On Tuesday, June 13, 2023, the OSP posted a notice on social media stating that Charles Bissue is wanted for reasons related to his work on the disbanded IMCIM.
The “Wanted by the OSP” announcement featured a photo of Charles Bissue and listed his full name, Charles Cromwell Nanabayin Onuawonto Bissue.
He was wanted in connection with “corruption-related offenses regarding the operations and outlays of the disbanded Inter-Ministerial Committee on Illegal Mining (IMCIM), particularly in relation to the seizure and management of excavators, machinery, road vehicles, and gold nuggets; and use of public office for profit.”
The OSP’s announcement follows allegations that it had obtained a warrant for the former IMCIM secretary’s arrest.
