CPP withdraws injunction application against EC, Esther Osei on Ejisu by-election

After the plaintiff, Emmanuel Gallo, withdrew his motion for an injunction against the Ejisu by-election, the Ashanti Region High Court in Kumasi dismissed it.

The Convention People’s Party (CPP) first requested on April 23 to postpone the April 30 by-election while a lawsuit against the Electoral Commission (EC) was being handled. The purpose of this case was to stop Esther Osei from standing in for the CPP in the ballot.

The CPP’s Ashanti Regional Chairman, Emmanuel Gallo, filed the lawsuit, claiming that the party had formally informed the EC on April 18 of its decision to abstain from the by-election.

Surprisingly, though, Gallo dropped the lawsuit, citing appeals for party unity from a number of sources, notably Naa Prof. Edmund N. Dele Chii VIII, the party’s former chair and current Paramount Chief of Nandom Traditional Area.

In an explanation of his choice, Gallo said, “The same introspection the Plaintiff considers to help with the unity and cohesion within the party. Based on these happenings and calls, the Plaintiff prays to withdraw the instant application and the Suit even though it is clear that the Defendant cannot legally conduct the elections with an illegitimate candidate purporting to be a constitutionally elected parliamentary candidate in the Ejisu bye-election. I pray accordingly.”

The court, chaired by Ellen L. S. Mireku, responded by dismissing both the lawsuit and the request for an injunction against the Electoral Commission as withdrawn. There was no cost order issued.
