The Greater Accra Regional Police Command’s application for an injunction against the Minority caucus’ planned demonstration against the Governor of the Bank of Ghana and his appointees has been met with preliminary legal concerns from the Minority caucus’ lawyers in parliament.
The application is uneven on the surface of the motion paper, and the court should reject it, claim the attorneys.
Lead Counsel Godwin Edudzie Tamekloe contends that Superintendent of Police Sylvester Asare’s signature on the motion document violates Section 19(a) of the State Proceedings Act and should be struck out as invalid.
While opposing the preliminary objection, Superintendent Asare stated that the court should consider the application because it is competent.
He requests that the court deny the application and hear their request to prevent the minority from having their protest.
Justice Edward Twum has postponed the proceeding till Friday, September 8.
This implies that the minority’s protest on September 5 is in doubt.
But the Minority in Parliament has moved its planned demonstration against Dr. Ernest Addison, Governor of the Bank of Ghana, and his appointees to Friday, September 8.
This came after the Accra High Court’s Financial and Economic Division, presided over the Justice Edward Twum, heard the minority’s preliminary objection.
The Organiser objected to the motion on Monday, September 4, 2023 (the day before the scheduled protest), despite the fact that the police had submitted an application to injunct the protest due to security concerns.
The minority’s legal representatives objected to the Police’s ability to start the action on their own, under the direction of Godwin Edudzi Tamakloe, Director of Legal Affairs for the NDC.
