The Peoples National Convention’s (PNC) presidential candidate, Bernard Mornah, filed an application to overturn the High Court’s ruling that upheld the Electoral Commission’s (EC) decision to disqualify him from running for president in 2024, but it was denied by a five-member Supreme Court panel led by Justice Tanko Amadu.
The parties to the case were first heard by the Supreme Court at approximately 9:30 am today, Friday, November 22, 2024, during an emergency sitting.
In order to give the EC’s attorneys time to submit their affidavit opposing Bernard Mornah’s application, the court postponed the case to 11 a.m.
The Court heard the parties’ oral presentations when it reconvened at 11:00 am and then got up to make its ruling.
Around noon, the Court reconvened and issued its unanimous ruling rejecting Bernard Mornah’s application. In essence, the Supreme Court ruled that the High Court’s ruling, which supported the EC’s decision, was supported by good law.
Attorney Harold Atuguba represented Bernard Mornah in court, while Attorney Justin Amenuvor represented the Electoral Commission. Since it was a constitutional issue, the Court did not grant the respondent (EC) any costs.
